Who is eligibleto receive cash?

An heir who will be inheriting at least $15,000 from a probate which is already open
or is currently being opened; or a beneficiary of a trust who will be receiving at least $15,000 in
distribution(s) from the trust within three years.

Are there any geographic limitations on funding?

No. There are no restrictions on where we can do business.
Although most of our funding is within the United States, cash has also
been provided to heirs in other countries.

Can you provide funding to an heir residing in a state different from the probate or trust?

Yes, it is common for the heirs of an estate to reside in a state different
from the deceased's state. This rarely causes a difficulty.

Do you charge the heir a fee for providing funding?

Yes, we charge a modest, one-time processing fee of $250 to partially
cover the cost of our underwriting and legal expenses. This processing fee
|is usually deducted from the cash advance. Other than this one-time fee and the
costs for out-of-pocket expenses, like overnight delivery service or cashier's check fees which
are also deducted from the advance, there are no other fees or charges
prior to providing funding to the heir.

Do you run a credit check on the heir?

In general, it is not necessary for an heir to have good credit to
receive an advance from us. However, in certain circumstances,
we may run a credit check as part of our underwriting process. A poor credit record
including delinquencies, bankruptcies, foreclosures, etc., will not affect our pricing
and normally does not have an influence on funding a transaction.

Do you require a funded heir to make payments against the money it provides?

No, after the heir receives funding from us it is not necessary for
the heir to make any payments to us!

If no payments are required, how do you recover your investment?

We recover our investment directly from the probate or trust.
The heir normally has no obligation to repay us. However,
if the heir provides us with false information, fails to disclose pertinent
information known to the heir, or deliberately interferes with our distribution(s) from
the probate or trust, we do have recourse against the heir.

What happens if a previously unknown creditor makes a claim on the estate?

We can only receive those distributions from the probate or trust
that are due the heir. Should the claim(s) of an additional ceditor
eliminate or reduce our distribution, we absorb the loss and we have
no recourse against the heir. However, if the heir was aware of the claim(s)
and failed to make appropriate disclosure to us, the heir would,
under this circumstance, have no obligation to us.

When do you get your investment returned?

We wait until the probate or trust distributes.

What happens if the distribution of the estate is delayed?

We must wait until the estate or trust is ready to distribute.
There is no recourse to the funded heir for any delays in the distribution.

What are the criteria that determine the cost of an advance from you?

 


The size of the advance and the estimated time to
distribution are the major factors affecting pricing. Larger transactions
are less expensive than smaller transactions.

Are there minimums and maximums for cash advanced by you to an heir or trust beneficiary?

Our minimum advance is normally $5,000. Advances up to $100,000
are made routinely and amounts in excess of $100,000 may be advanced
depending on specific circumstances. Essentially, there are no upper limits to the amount to be advanced.

What steps need to be taken for you to consider funding a transaction?

Upon request, we will send a kit of materials including a short
form called an Heir's Information Summary. This form is to be returned
to us together with copies of personal identification and relevant probate documents.
